Mohale legal team ‘considering’ defamation case against Somizi

Mohale Motaung’s legal team is considering whether they want to pursue a defamation case against Somizi, after divorce is withdrawn.

South African actor Mohale Motaung’s legal team is reportedly considering a defamation case against media personality Somizi Mhlongo.

It seems Somizi Mhlongo and Mohale Motaung’s legal battle over their divorce is over…but the 28-year-old’s lawyers are considering a defamation case — according to Tshisa Live.

“This is the end of the road in terms of the divorce as it’s considered they were never married. We are aware of actions that can be taken which include the alleged assaults,” said the lawyers to Tshisa Live.

“And we are also considering whether there is a possible case of defamation in respect of the allegations that were publicly made that our client is the one who issued the summons and wanted half of Somizi’s assets, which painted him as a gold digger,” the lawyers continued.

This follows Somizi admitting that he withdrew the divorce summons. Mohale allegedly denied entering into a “valid customary [marriage] on September 28 2019,” as per legal documents seen by the publication.The Idols SA judge initially sent the 28-year-old divorce summons noting that they were married in community of property under customary law.

The publication also reports that Somizi’s legal representatives revealed that after obtaining expert opinion – not all the customs were complied with. This means despite having a public wedding, which was streamed as a Showmax special, the pair were never married in the eyes of the law.

So, the marriage was non-existent. Therefore, Somizi – who instituted the divorce proceedings has to pay Mohale’s legal fees. This is common.

  • The Idols SA judge took to Instagram to address the looming speculation via an official statement. In the statement, Somizi claimed the following were facts of the divorce case. 
  • The media personality and Mohale were both previously in agreement that they had entered into a valid customary marriage. Mohale revealed that they had been married in community of property.
  • Somizi issued the summons for divorce.
  • The pair initially agreed to enter into settlement negotiations in an attempt to end the marriage amicably. 
  • Somizi decided to withdraw the divorce after the pair were unable to reach an agreement on the existence of the marriage. The media personality claims that they initially agreed that the marriage existed, but Mohale claimed that no valid marriage took place.

  • The media personality got an expert opinion in customary law and thereafter accepted that no customary marriage was entered into. So, the action for divorce has been withdrawn. 
  • Somizi claims that he opted to pay the legal costs despite the potential of him no longer being liable for the costs.
  • There is no court order to the effect. 
  • The matter was never heard by a court. No court has considered the merits of the dispute and made a ruling on the disputes.
