Yanga ‘Bara’ Nyalara matter could be transferred to High Court at next appearance

The case is moving swiftly as none of the accused has applied for bail thus far. It could be transferred to the High Court on 14 November.

Yanga ‘Bara’ Nyalara, the alleged Khayelitsha extortion gang boss, made another appearance before the Cape Town Magistrate’s Court on Tuesday, 4 October. The State added another accused person and there are now four people charged in this matter.

Nyalara, Wandile Tofile, and the fourth accused, Lundi Zweni, are charged with murders, attempted murders, illegal possession of firearms and illegal possession of ammunition which took place on 15 May 2021.

The matter is proceeding swiftly as none of the accused has exercised their right to apply for bail thus far.

“Advocate Mervyn Menigo told the court that only ballistics and cellphone analysis reports were outstanding and they will be available at the next appearance on 14 November 2022,” said National Prosecuting Authority (NPA) spokesperson Eric Ntabazalila.

On 14 November, the State expects to serve the accused with an indictment and summary of facts in the matter and the case will be transferred to the Cape Town High Court, where the matter will eventually go to trial.

As previously reported, the State also charged Bara and Tofile under the Prevention of Organised Crime Act, as they were prominent members of a gang.

The gang allegedly engaged in extortion of informal businesses, drug dealing and other crimes in Khayelitsha, Cape Town. They also eliminated competing extortion gangs in the area.

Before his arrest on 1 July 2022, Bara was considered the most wanted suspect in the Western Cape. Menigo revealed that the fourth accused in this matter was linked to a Gugulethu mass shooting that left eight people dead in June 2021.
