SIU: André de Ruyter GUILTY of maladministration

The Special Investigating Unit (SIU) has accused former Eskom CEO André de Ruyter of maladministration.

SIU SAID DE RUYTER IS GUILTY OF MALADMINISTRATION

This comes after he initiated an investigation into corruption at the entity without the approval and authorisation of the Eskom board.

De Ruyter authorised an intelligence investigation by the former police commissioner George Fivaz’s forensic firm, George Fivaz Forensic and Risk (GFFR). The operation was funded privately, including by Business Leadership South Africa.

DE RUYTER AUTHORISED AN INTELLIGENCE INVESTIGATION

According to reports, the head of the Special Investigating Unit (SIU), Andy Mothibi, said despite possible good intentions, De Ruyter made himself guilty of maladministration by authorising a clandestine investigation into the operations of the power utility.

Briefing Parliament’s Standing Committee on Public Accounts (Scopa) on Tuesday, Mothibi reportedly said De Ruyter failed to adhere to an important corporate governance requirement and instead excluded the board as the accounting authority at Eskom on this investigation.

DESPITE POSSIBLE GOOD INTENTIONS, HE MADE HIMSELF GUILTY OF MALADMINISTRATION

The investigation unit is considering formally reaching out to De Ruyter, who is currently working as a fellow at Yale University in the US, as part of that process.
