The trial within trial seeks to determine the admissibility of confessions allegedly made by Sibiya and accused 2 Bongani Ntanzi.

According to the State, Sibiya confessed following his arrest in May 2020 to a police officer called Colonel Mhlanganyelwa Mbotho.

On his second day in the witness box, Sibiya told the court that he never confessed. Instead, Mbotho forced him to sign a pre-written confession.

On Monday, Sibiya told the court that everything that happened the day he allegedly confessed to killing Senzo Meyiwa was against his will.

“Everything that happened on the day was not out of my free will. I was abused, pointed at with big firearms, and questioned from the morning until late. All that I did on the day I did it for my safety to save my life. No one there was on my side or protecting me,” he said.

Sibiya further told the court that even though he reported the alleged assault to the police, he did not get assistance from anyone.

Sibiya alongside Bongani Ntanzi, Mthobisi Prince Mncube, Mthokoziseni Maphisa and Fisokuhle Nkani Ntuli are on trial for the murder of Meyiwa who was shot at the home of his girlfriend and singer Kelly Khumalo on 26 October 2014 in Vosloorus.

The trial continues.
