Busisiwe Mkhwebane may lose a R10million ‘golden handshake’ if she is fired. Her contract ends mid-October.

Outgoing Public Protector Busisiwe Mkhwebane has not taken the Section 194 Committee recommendation to the National Assembly to have her removed from office lying down.

Last week the Section 194 Committee officially adopted their report which found her guilty of misconduct and incompetence.
Should she be fired, she forfeits a R10million gratuity, which is given to a Public Protector at the end of their seven-year tenure.
However Mkhwebane believes she is entitled to her benefits even if she was fired.
“They are hired to deny me of my hard-earned benefits, which cannot be taken away in terms of the law”, says Mkhwebane.

“As I have always said, in the process of fighting them, if I perish, I perish. The way forward in this matter is that I’m deliberating with the legal team, still finalising the strategy on how we are proceeding with the issue of reviewing this report.”

Last week, the Democratic Alliance accused the Suspended Public Protector of using delay tactics to ensure she reaches the end of her tenure.
Mkhwebane’s contract ends on 14th October.
The DA deputy chief whip, Annelie Lotriet says she will make sure the Public Protector is impeached before then.

“It would be a public outrage if someone who significantly harmed the Office of the Public Protector could escape unscathed and receive a substantial final payment at taxpayers’ expense through deliberately avoiding accountability”, says Lotriet.
