Dr Nandipha to stay behind bars as the judge rejects her motion

As a result, it appears that Dr Nandipha will continue to be detained throughout her legal proceeding.

Dr Nandipha and her wanted lover Thabo Bester were both apprehended in Tanzania in April 2023.

In connection with Bester’s escape from the G4S-run Mangaung Correctional Facility in the Free State, she is being held on 12 counts.

Dr Nandipha filed an urgent appeal to challenge her arrest rather than request bail, contending that she was kidnapped and not rightfully detained.

Authorities have refuted Magudumana’s claims, claiming that she was detained on South African territory.

She was represented by renowned international attorney Anton Katz SC in the Bloemfontein High Court for the hearing of her urgent plea.

Loubser said on Monday that even if Magudumana’s application didn’t fulfil the criteria to be treated as an urgent matter, he would still hear the case out of fairness.

While that may have been the case, Dr Nandipha voluntarily boarded the plane that brought her and Bester back to South Africa, according to Loubser.

This proves Magudumana was not kidnapped from Tanzania as she claimed and gave her consent to board the aircraft.

According to SABC News, Judge Loubser rejected Magudumana’s plea with costs based on the consent problem.

The SAPS’s advocate, Neil Snellenburg, testified in court that Dr Nanidpha never objected to boarding a private plane that had been leased to bring her and Facebook rapist Thabo Bester back to the nation for prosecution.

According to Aaron Motsoaledi, there were just 2 (two) Thabo Besters in the NPR. One was disqualified from the search because he is a young man and 19 years old.

The other is a 40-year-old male who they were able to locate in Ratanda, Heidelberg.

When they actually went to see him, they discovered that he had previously gone to the police after hearing that a Thabo Bester was caught and arrested.

He was not the Thabo Bester who fled from a Bloemfontein Correctional Services prison, according to police.

Thabo Bester was not visible in either of the other two databases.
