Court to rule Magudumana’s bail application verdict TODAY

Today is the day where we will know whether the Bloemfontein Magistrates Court will grant Nandipha Magudumana’s request for bail.

Today, the Bloemfontein Magistrates Court is likely to rule on Nandipha Magudumana’s request for bail.

Following the submission of final arguments by both her legal team and the State, the court last week postponed her application.

What is Magudumana charged with?

Magudumana is charged with helping her partner Thabo Bester, who was convicted of rape and murder, make a daring escape from the G4S-run Mangaung Correctional Facility in May of last year.

She is also accused of fraud, desecration of a body, corruption, arson, harboring and hiding a prisoner, and subverting the course of law.
According to sources, if found guilty, she may receive a 40-year prison term.

The two were deported to South Africa after being apprehended in Arusha, Tanzania, in April of this year. According to reports, Magudumana was detained while holding two passports.

While Bester is being held in custody at the Kgosi Mampuru II Correctional Facility in Pretoria, she has been detained at the Bizzah Makhate Correctional Services prison in Kroonstad.

The State rejected all of her legal team’s attempts to persuade the court to grant Magudumana bail. It was stated that because she left the nation in March of this year, she poses a flight risk.

Is there hope that she will be granted bail?

Magudumana said that Bester kidnapped her to force her to flee the country in her affidavit through her lawyers. According to her, she was thrown into a car on 17 March , 2023, by the prisoner and had no idea where she was heading.

She reportedly expressed fear and helplessness.

According to the State, Bester and Magudumana left the nation in March 2023 and eluded law enforcement for 11 months.
After the State rejected her candidacy on the grounds that she was facing five fraud cases totaling millions, Magudumana denied accusations that she was a flight risk.

The petitioner, according to her legal team, had not been accused, detained, or contacted by the police.

Motloung final statement

By outlining the flaws in its case, the State, according to Motloung in his final statement, has inflicted itself a damage.

Motloung emphasized that Magudumana had claimed in her affidavit that she had no active cases or prior convictions.

According to him, Magudumana’s statement is still valid.
