Aricum revealed that Dr Pillay loaned money to Thembekwayo in July 2021. The summons was issued on 13 January at his known business premises in Sandton, however, the sheriff could not find him.

In addition, Aricum said that Thembekwayo’s lawyer, Suzette Marx, refused to receive the summons on behalf of her client in March this year, saying she has not received instruction from him to do so. However, when Thembekwayo signed and made two payments of half-a-million rands loan he took from Dr Pillay, he added the offices of Marx & Associates as the address to receive legal papers or documents.

The doctor’s lawyers further said that Thembekwayo refused to sign the acknowledgement of debt in his personal name, he also reportedly changed the details of his company before signing.
