LATEST: Chiefs could learn fate on FRIDAY over fielding ineligible players

Chiefs will appear before the PSL disciplinary committee on Friday in relation to new charges over fielding two ineligible players.

The new charges against Chiefs were confirmed by PSL prosecutor Zola Majavu at the beginning of April, which related to the fielding of two ineligible players, said to have taken place during Chiefs’ 2-0 win over Sekhukhune United in December.

“Kaizer Chiefs Football Club has been charged with fielding two defaulters, namely Aden McCarthy and Mduduzi Shabalala in the match between themselves and Sekhukhune United on 12 December 2021,” PSL prosecutor Zola Majavu said in a statement at the time.

“These players were not properly registered for purposes of the DStv Premiership league but were registered for purposes of the reserve league. That is the basis for the allegations they are facing.”

It was previously confirmed that although Amakhosi have since appeared before the committee, the matter was then postponed to 13 May 2022.

“Kaizer Chiefs Football Club will be appearing before the PSL DC tomorrow, 13 May to answer to charges of fielding defaulters, namely; Aden McCarthy and Mduduzi Shabalala between themselves and Sekhukhune FC,” Majavu commented in the latest update, as per Soccer Laduma. “This matter was previously postponed to tomorrow at the request of Kaizer Chiefs.”

Chiefs are no strangers to controversy this season

Already, there is an ongoing dispute over the two league matches that Chiefs missed against Golden Arrows and Cape Town City towards the end of last year due to a widespread Covid-19 outbreak at their headquarters in Naturena. Those games were eventually replayed after a key arbitration decision.

In short, the two missed matches were declared to be replayed even as the matter remains unresolved. Depending on the outcome of the legal proceedings, if it goes in favour of Chiefs, then the results of the two replayed matches will stand.

However, if the league is successful in its review application, the log will be adjusted to reflect the outcome “as if the matches had not been played”

“Kaizer Chiefs will appear before the PSL DC on 17 May 2022 at 16:00,” Majavu explained. “This is continuation of the matter that was previously on the roll, which I withdrew after the arbitrator’s award under the hand of Advocate Nazir Cassiem SC had found that Chiefs were justified in not fulfilling those fixtures due to an act of God, with specific reference to the Covid situation. The PSL executive committee elected to challenge that outcome and took it on review. In the result, I decided to not proceed further with that case, but rather to await the outcome of that review in the High Court

“I can now confirm that the review in the High Court was finalized on 10 May 2022. I can confirm that the award of Advocate Cassim SC was reviewed and set aside. In the result, the referral to arbitration was equally set aside. I have decided to proceed with the case. Kaizer Chiefs must still come before the DC and account for their non-fulfullment of those fixtures.”
