South African clients are often in doubt about how their UK immigration status will affect the status of their children. This week we discuss two scenarios, in order to provide some clarity.

  • If the parent was born in South Africa and naturalised in the United Kingdom as a British citizen, the British citizenship will be passed to all children born after the date of Naturalisation with the exception of illegitimate children born to British fathers prior to 1 July 2006.
  • If the parent was born in South Africa, and also have British citizenship, obtained via his/her parents, there are three possible ways in which registration for the child can be done;
    •  The first is registration as of right where the parent lived in the UK for three years prior to the child’s birth.
    • The second is registration as of right where the parent and child lived in the UK for three years after the birth of the child.
    • The final route is discretionary, based on strong links to the UK. So if you are British by descent, you are welcome to contact us and we will be able to advise if your child could be eligible for British citizenship.
