UK Home Office on the immigration stance of EU nationals in the UK

There have been some significant changes in the UK political landscape, since the referendum on Brexit. Only time will tell how the newly appointed Home Secretary, Ms. Amber Rudd will be handling Immigration over the coming months.

Many EU nationals residing in the UK are understandably very concerned about how all the changes can affect their immigration status in the UK. Fortunately, the UK Home Office has released a statement on the issue, which should bring some calm to these fears.

The UK Government said in a statement that the decision about when to trigger Article 50 and start the formal process of leaving the EU would be for the new Prime Minister, Ms. Theresa May. The UK will remain a member of the EU throughout this process, and until Article 50 negotiations are concluded.

The statement further said that when Britain does leave the EU, the UK Government fully expects that the legal status of EU nationals living in the UK, and that of UK nationals in EU member states, will be properly protected. The statement further said that the UK Government recognises and values the contribution made by EU and other non-UK citizens who work, study and live in the UK.

Guidelines from the UK Home Office to EU Nationals living in the UK

The UK Home Office has released the following guidelines to EU Nationals;

  • EU nationals who have lived continuously and lawfully in the UK for at least five years automatically have a permanent right to reside. This means that they have a right to live in the UK permanently, in accordance with EU law.
  • EU nationals who have lived continuously and lawfully in the UK for at least six years are eligible to apply for British citizenship if they would like to do so.
  • EU nationals who have lived in the UK for less than five years continue to have the right to reside in the UK in accordance with EU law, as there has not been any change yet in policy or processes.
