Police Files: Durban home invader sentenced to 31 years in jail for murder

The suspect survived when his gang members crashed their vehicle and were killed on the M13 during a high speed police chase in 2019.

A 33-year-old housebreaker and murderer, who was the sole survivor when his accomplices crashed their getaway vehicle during a police chase, has been sentenced for his crimes to 31 years in jail in the Pinetown Regional Court this week.

National Prosecuting Authority regional spokesperson Natasha Kara said Sboniso Msomi, 33, had been sentenced to an effective 31 years imprisonment for the February 2019 house-breakings and murders that he was involved in.

Kara said Msomi and his co-conspirators were fleeing from the police after committing house robberies in the Kloof and Wyebank areas when they crashed their vehicle on the M13. They had fled from the scene of the robberies with jewellery, TV, laptops, cell phones, cash and digital cameras, among other goods.

“While being pursued by the police, and in an exchange of gunfire, they lost control of their vehicle on Field’s Hill and crashed. Msomi tried to escape but was arrested near the crash site in possession of items belonging to the victims of the housebreakings,” Kara said.

“He was treated for injuries and taken to hospital while his co-conspirators succumbed to their injuries. The stolen items were returned to the victims.”

Msomi was sentenced to two ten year jail terms for two counts of housebreaking with intent to steal and theft, six years imprisonment for attempted murder and 15 years imprisonment each for the two counts of murder of his co-conspirators. The sentences amount to 56 years imprisonment, however the court ruled that the sentences for the two murders and one house breaking should run concurrently, resulting in an effective 31 years imprisonment.
