Alleged underworld kingpin Nafiz Modack has now been charged with the murder of top Cape Town detective Charl Kinnear in addition to the attempted murder, extortion, and kidnapping charges brought against him over the past two weeks. His co-accused Ricardo Mogan was also charged with involvement in the killing.
Appearing at the Blue Downs Magistrates’ Court on Friday for his bail application, Modack and four co-accused Zane Kilian, Anti-Gang Unit cop Ashley Tabisher, Jacques Cronje and Morgan were led into the dock under heavy police guard, with the court cordoned off with razor wire to prevent anybody gaining access to them.
Modack charged with murder of Cape Town cop
The State has been preparing the charges of murder against Modack since his arrest in April, with the Hawks having initially said that the alleged gang boss was responsible for the murder of a police officer. These charges weren’t forthcoming during Modack’s several appearances since his arrest, but were they eventually consolidated on Friday.
Kilian is the only other person currently charged with the murder of Kinnear, who was gunned down outside his Bishop Lavis home in September last year. Kilian is accused of facilitating a track and trace effort by pinging the cell phones of Kinnear as well as “thousands of others”, including that of prominent Cape Town attorney William Booth.
“We sincerely hope that the family will find comfort on the additional arrest, as this brings us a step nearer to closure,” said Acting Hawks Lieutenant General Tebello Mosikili.
The South African is awaiting feedback from the National Prosecuting Authority (NPA) on the most recent charges levelled against Modack and will update this story when it is forthcoming.
Detective’s widow unsurprised by charges
Kinnear’s widow, Nicollette Kinnear, said last week that Modack “hated her husband’s guts” because he was immune to the temptation of kick-backs allegedly offered by Modack to the South African Police Service (SAPS) for turning a blind eye to his activities.
“I am not surprised because my husband investigated the underworld and investigated him. Mr Modack hated my husband’s guts. It is what it is,” she told the Sunday Times.
“Unfortunately some people have given themselves certain stature and they expected to be treated with kid gloves. My husband treated all people the same way. It is not the norm that you are arrested this morning and go to court this afternoon and then bail is granted. But certain people are treated differently. Why? I don’t work in the justice system. My husband was not dictated to. He just did his job.”
