Huh? Nhlanhla ‘Lux’ Dlamini to spend weekend behind bars

What is going on here? This is just sketchy! So Operation Dudula leader Nhlanhla “Lux” Dlamini will spend the weekend behind bars despite police saying he was NOT arrested but only taken in for questioning. 

WHAT HAPPENED ON FRIDAY? 

According to a report by News24 was expected to appear in the Roodepoort Magistrate’s Court on Friday after he was NOT arrested on Thursday.

He reportedly faces charges of housebreaking, theft, and malicious damage to property.

When asked about this police spokesperson Colonel Dimakatso Sello said Dlamini was brought in by police for questioning on Thursday evening, 24 March 2022.  

Operation Dudula secretary-general Zandile Dabula addressed scores of the movement’s members outside court, telling them that Dlamini was not appearing as the matter had been postponed to Monday. 

“A person of interest was brought in for questioning tonight, 24 March 2022 by the police with regard to a housebreaking case opened at Dobsenville Police Station on Wednesday.” 

On Friday, Sello, however, said Dlamini was detained. 

Yes, this is confusing as Operation Dudula deputy chairperson Dan Radebe confirmed to the media that Dlamini was arrested shortly after he came out of the Kaya FM studios in Parktown, where he had had an interview.

Dlamini spoke to the media on Thursday evening outside the John Voster Police Station, where Dlamini was detained.

DIFFERENCE BETWEEN ARREST AND DETAINED? 

The Criminal Procedure Act (CPA) provides strict guidelines about when a person may be arrested. It gives police the right to arrest and detain an individual on the basis of a warrant of arrest, or if an officer witnesses that person committing an offence.

Under the CPA, it’s up to the National Prosecuting Authority of South Africa to determine whether charges against someone are valid. In other words, it’s not the job of individual police officers to weigh evidence or explanations provided to them at the time of an arrest.

DLAMINI ACCUSED MALEMA OF BEING JEALOUS 

 In an eNCA video on Thursday evening, Dlamini said Julius Malema couldn’t stand it when a strong young man spoke, and people listened better. 

“He’s jealous of the relationship between #OperationDudula and the police.” 

Dlamini accused Malema of being jealous and that he hated the progress made by #OperationDudula, saying it is because their progress is within the boundaries of the law. 

It is believed the case of housebreaking was made by Soweto resident Victor Ramerafe, whose home was allegedly ransacked by Operation Dudula members on Sunday.

The group claimed to be acting on tip-offs from the community that drugs were being sold from Ramerafe’s home. During the raid, no drugs were found, but Ramerafe said his property was damaged.

The EFF had backed Ramerafe in laying assault and theft charges against Dlamini.
