Hillary Gardee’s family suing Justice Department for R18m

The family of late Hillary Gardee is suing the Justice and Correctional Services Department for alleged negligence.

The family of Hillary Gardee is suing the Justice and Correctional Services Department for R18 million.

Gardee’s family in Mpumalanga is suing the Department over alleged negligence.

The family detailed why they are suing the Department

The Department says it has information that one of the accused in Hillary’s murder was on parole when she was murdered.

Rasie Nkune was arrested for an alleged rape case which was later withdrawn.

Gardee’s family says it has information that Nkune violated his parole. According to the family, Nkune violated his parole conditions by disappearing for almost two years.

Nkune was released in 2019 and the charges for the violation were not pressed against him.

The family believes Hillary would still be alive if Nkune was rearrested

The law firm representing the Gardee family stated in a letter that Nkune absconded from parole for two years.

According to SABC News, the Gardee family believes that if the Department properly performed its duties, Hillary would be alive today. Adding that Nkune would have been re-arrested.

If he were re-arrested in 2019, he would only be eligible for a release in 2023.

They are now demanding R18 million from the Department for constitutional damages and trauma from the Department.

Hillary Gardee murder trial set for April 2023 in High Court

Previously, it was reported that the four men accused of murdering Hillary Gardee will face trial in the Mbombela High Court in 2023. The accused were served with an indictment by the State on Friday, 16 September.

National Prosecuting Authority (NPA) spokesperson Monica Nyuswa said one of the accused, Albert Gama, was denied bail.
