The Economic Freedom Fighters (EFF) has welcomed the South Gauteng High Court Judgement which dismissed AfriForum’s case to have the ‘Kill/Kiss the Boer’ song constituted as hate speech.

The EFF has also slammed AfriForum calling the organisation self-proclaimed racist experts.

The Judge on the matter ruled that AfriForum failed to show that the lyrics of the song contravene the Equality Act or demonstrate a clear intention to harm or incitement.

It was ruled that declaring the ‘Kill/Kiss the Boer’ song as hate speech, would curtail freedom of expression. AfriForum was also ordered to pay the EFF’s legal costs.

In sharing a summary of the verdict, Molahleli confirmed that all five witnesses summoned by the lobby group were disqualified from the case. Even their head of policy, Ernst Roets, was amongst the exclusions.

The EFF said there are ‘Swaart-Gevaar’ proponents who want to create a picture that there is white genocide in South Africa but also undermine the racist trope that black people are irrational beings who will kill because of a chant or a song.

“The court reaffirmed submissions by Julius Malema that liberation songs should not be interpreted literally but recognised as a critique of a system of oppression. ..Let us sing liberation songs freely, in honour of the brave heroes and heroines who fought for our political freedom,” the Red Berets said.
