The buck stops here for Tom Moyane, said the Constitutional Court on Tuesday, after it threw out the axed SARS Commissioner’s appeal to get his job back.

Constitutional Court rules against Tom Moyane

The application was brought by Moyane to the highest court in the land after he was refused the right to appeal his judgment at the North Gauteng High Court.

President Cyril Ramaphosa, in the latter parts of 2018, heeded the call of retired Judge Robert Nugent to axe Moyane for his role in the destruction of the revenue services agency.

The Nugent inquiry, for the most part of the year, heard testimony about Moyane’s dealings and how he, together with key figures in the alleged Zuma corruption ring, ran SARS to the ground.

As reported by EWN, the train has left the station for a Moyane who is adamantly fighting a lost cause.

It was highly unlikely that the courts, based on the process Ramaphosa took to arrive at that decision, would have ruled against the axing.

Moyane defense concession

Eric Mabuza, the legal representative of Moyane, conceded to the fact that they have run out of options, for now.

“We note the ruling of the Constitutional Court with respect. It does not come as a complete surprise, since the Constitutional Court typically only grants leave to appeal against interim orders only in exceptional circumstances.

“Mr Moyane genuinely believed that the circumstances of this particular case were sufficiently exceptional. The court has respectfully held otherwise,” Mabuza stated.

New SARS commissioner on the horizon

At the moment, Ramaphosa has tasked a SARS panel, chaired by former finance minister, Trevor Manuel, to come up with a shortlist of candidates who are suited to take Moyane’s seat on a permanent basis.
