Public Protector Busisiwe Mkhwebane said recently that President Cyril Ramaphosa must withdraw his letter. The letter in question was one about Mkhwebane’s possible suspension.

Mkhwebane’s letter has a few demands for Ramaphosa

She also wants President Ramaphosa to step away from her parliamentary impeachment process. Mkhwebane believes that the president is “heavily” conflicted as her office is investigating his conduct.

The investigations are concerning state funds that were allegedly misused for internal ANC campaigns. There are allegations of collusion between the president and the Minister of Justice. She described the allegations as “judicial capture”, reports EWN.

Mkhwebane was responding to Ramaphosa’s letter in which he gave her 10 days to deliver reasons why she should not be suspended. The letter the embattled Public Protector sent came after her Constitutional Court application to rescind its earlier ruling.

The ruling was with regard to the Parliamentary inquiry into her competence to hold office. Ramaphosa followed the inquiry by sending Mkhwebane the letter. She has until Wednesday, 30 March, to respond.

The bid to give Public Protector Advocate Busisiwe Mkhwebane the boot is nearing a crescendo, with President Cyril Ramaphosa giving her 10 days to explain why he should not suspend her.

The Public Protector and Ramaphosa have been at loggerheads for quite some time, in respect of their previous legal battles. The bid to suspend Mkhwebane stems from the impeachment process she faces.

In a statement released on Thursday, 17 March 2022, Mkhwebane says she learnt via the news outlets that Parliamentary Speaker Nosiviwe Mapisa-Nqakula wrote to Ramaphosa, informing him about the process to impeach her

“This afternoon [Mkhwebane] received a letter from the president confirming the news reports and informing her that he is considering suspending her in terms of section 194(3)(a). The letter further invites the public protector to, within 10 working days, provide reasons why the president should not take such a step,” read a statement from Mkhwebane’s office.
