Mkhwebane back in court TODAY – here are all the details…

Public Protector Busisiwe Mkhwebane is back in the Western Cape High Court today, but what is she planning to do?

On Tuesday, 25 October, Public Protector Busisiwe Mkhwebane will make her way back to the Western Cape High Court.

Ramaphosa’s suspension of Mkhwebane was found to be invalid and improper

Last month, Mkhwebane was victorious when the same court found that her suspension by President Cyril Ramaphosa was both invalid and improper.

Mkhwebane is immersed in an ongoing battle to return to her desk. However, the judgment in which Ramaphosa’s suspension was found invalid was not with immediate effect.

The Public Protector revealed that she intends on approaching the Supreme Court. Her hopes are to appeal the above ruling, explaining that it was not in the interest of justice.

This is Mkhwebane’s third attempt at returning to office.

Two weeks ago, there was a ruling that lifted her suspension – pending confirmation by the Constitutional Court. The Public Protection disagreed with this as it involves a decision made by Ramaphosa.

What is the Public Protector’s aim in court on 25 October?

Today, 25 October, Mkhwebane will argue that the bench made errors of both fact and law as they did not grant her temporary relief, reports EWN.

She believes this to be sound as there were blatant illegalities that went with the president’s decision to have her suspended from office.

The African Transformation Movement (ATM), United Democratic Movement (UDM) and Pan Africanist Congress (PAC) are all backing the Public Protector’s application for leave to appeal to a higher court.

“This has got nothing to do with the competence of the Public Protector, but it is a personal vendetta, personal hatred against Advocate Mkhwebane,”

ATM leader Vuyo Zungula previously said.

On the other hand, the Democratic Alliance and the Presidency are opposing the application.
