The EU settlement scheme and what is required for dependent relatives.

(Partner Content) Dependent relatives, but not dependant parents, of EU nationals need to apply for a residence document issued under the EEA Regulations before applying for pre-settled or settled status.

They will need to apply for the document before 1 January 2021 and will then have until 30 June 2021 to submit an application under the EU Settlement Scheme.

This rule means that dependant relatives of EEA nationals will no longer be able to live in the UK after January 2021 (unless they meet the above criteria).

So, basically, until now, e.g., if you are French national, you have been able to sponsor your non-EEA uncle or cousin who is/has been financially dependant on you or who is/has been a member of your household or in strict need of personal care on serious health grounds. However, this will no longer be possible from next year (unless the Brexit transition period is extended).

So EU nationals will only be able to sponsor immediate family members and long-term partners, but no other relatives, unless they apply for a residence document issued under the EEA Regulations before applying for pre-settled or settled status. It is crucial that they apply for this residence document before 1 January 2021.

Registering under the EU Settlement Scheme during Covid-19

It is vital that all EU citizens who want to keep living and working in the UK, apply under the EU Settlement Scheme.

Fortunately, you do not need to be physically present or submit any biometric information when you register under the EU Settlement Scheme. Breytenbachs will be able to assist you with your application via SKYPE and email, and there is no need to be physically present.
