Vusi ‘Khekhe’ Mathibela, also known as ‘Mamelodi’s No 1 Tsotsi,’ along with three other people, have been found guilty of murdering North West businessman Wandile Bozwana.
The High Court in Pretoria found all men guilty of premeditated murder, attempted murder, possession of a firearm and possession of ammunition. The co-accused in the matter are Sipho Patrick Hudla (40), Matamela Robert Mutapa (46) and Bonginkosi Paul Khumalo (42).
The three men are said to have fatally shot Bozwana, on Mathibela’s instructions, back in October 2015. According to the National Prosecuting Authority (NPA), they followed Bozwana, who was with his business associate, as they were driving from Sandton to Pretoria, and pounced on them as soon as they reached the Garsfontein off-ramp.
“The three men got out of the BMW car they were driving and started shooting at Baloyi’s car and fled the scene. Both the deceased and Baloyi were shot, however, Baloyi managed to drive until she stopped at Garsfontein road, when police and emergency services arrived. Bozwana and Baloyi were taken to the nearest hospital, where he later died due to multiple gunshot wounds,” said NPA spokesperson regional spokesperson Lumka Mahanjana.
VUSI ‘KHEKHE’ MATHIBELA, CO-ACCUSED TO BE SENTENCED IN AUGUST
According to the NPA, Vusi ‘Khekhe’ Mathibela and the three co-accused had pleaded not guilty to the murder of Wandile Bozwana.
All four men were arrested on different dates, between 2015 and 2016. Three of them have been in custody since their arrest, however, Mathibela was granted R50 000 bail in December 2016, after he handed himself over at the Brooklyn police station, in January 2016.
“He was then rearrested in 2019 after he violated his bail conditions, which were revoked and his bail money was forfeited to the state, and has been in custody since,” Mahanjana added.
State prosecutor Adv. Jennifer Cronje told the court she presented evidence to prove the guilt of the four men beyond reasonable doubt and that they all had a common purpose in killing the deceased. The Director of Public Prosecution, Adv. Mzinyathi welcomed the conviction, and lauded the investigating officer Sergeant Evans Butso Mongwe for his work, having started investigating the matter after the incident in 2015.
The matter was postponed to 4 August 2022, for sentencing proceedings.
