Babalo Ndwayana, the Stellenbosch University student whose belongings were urinated on by a fellow student, has now opted to pursue criminal charges.

In video that has since gone viral, Theuns du Toit is seen urinating on Ndwayana’s desk, including his books and laptop reportedly loaned from the university. The clip, captured by Ndwayana himself, has sparked outrage, with many labelling it as racist.

While du Toit has been suspended, this has done little to quell the anger that has been voiced by many, including student organisations.

STELLENBOSCH STUDENT HAS LAID CRIMINAL CHARGES

Babalo Ndwayana had very little to say to the media outside the police station in Stellenbosch on Tuesday afternoon,17 May 2022, after opening the case, but SASCO Western Cape’s Sifiso Zungu said they were pleased with how police have handled the matter. SASCO and other bodies have been vocal in their call for Theuns du Toit to face tougher action for the utination video, including expulsion from the university.

“We were able to get good assistance from the police station because they were able to just listen to the story of the victim and then give us brief detail and tell us which cases need to be open, then from that procedure we move with them. I think we are happy and the victim himself is happy with what has just happened. So we just wait for further communication because they said we must wait for an SMS with a case number,” Zungu said.
