Afriforum to prosecute NPA boss on charges of fraud and perjury

National Prosecuting Authority’s deputy director Nomgcobo Jiba faces a fresh legal battle after Afriforum announced on Thursday that they will prosecute her privately on charges of fraud on perjury.

The civil rights group announced this move during a  media briefing in Centurion on Thursday, where representative Kallie Kriel said the NPA had refused to prosecute Jiba, despite court rulings against her.

This follows Jiba’s suspension after the Kwa-Zulu Natal High Court found her decision to prosecute the province’s former Hawks head Johan Booysen to be unconstitutional and her conduct to be dishonest.

Jiba will face a charge of fraud for deciding to prosecute Booysen without facts, one of perjury for lying under oath and another for defeating the ends of justice.

Present alongside Kriel at the briefing, Booysen said he is thankful that Afriforum are pursuing the matter.

“…in that regard, I’m actually grateful that Afriforum has come to my aid to institute this private prosecution,” he said.

“I believe that we are all equal before the law and in this instance the National Prosecution Athourity has aggravated the constitutional mandate of withdrawing the charges against Advocate Jiba and that’s why we decided to commence with the private prosecution.”

These charges will be pursued by Gerrie Nel, who was appointed by the organisation as head of private prosecutions.

Jiba’s fitness to hold office was called into question earlier this year, following concerns over her handling of high-profile cases. She alongside Lawrence Mrebi were struck off the roll of advocates of the General Council of the Bar of SA.

However, after being granted leave to appeal the decision, President Jacob Zuma – who Jiba is known to be an ally of – decided  against instituting a commission of inquiry against her.
