I am on an ancestry visa in the UK, based on my husband’s grandfather being a British citizen. Things are not well between me and my husband and I am considering asking for a divorce. However, I am concerned about how this will affect my visa status in the UK. We have been in the UK for just over two years.

Question:

I am on an ancestry visa in the UK, based on my husband’s grandfather being a British citizen. Things are not well between me and my husband and I am considering asking for a divorce. However, I am concerned about how this will affect my visa status in the UK. We have been in the UK for just over two years.

Answer:

From the information you have provided, it seems like you are in the UK as a dependant on your husband’s ancestry visa. Your dependency visa is based on your marriage to your husband. If you get divorced you will no longer be able to live and work in the UK, as your dependency visa will no longer be valid.

In order to continue to live and work in the UK, if you get divorced, you will have to qualify and apply for a visa in your own right.
