The United States have implemented a travel ban on the 30th of January in terms of which entry into the United States is suspended for all foreign nationals who were physically in South Africa during the 14-day period preceding their travel to the United States.

A further executive order from the American presidency orders all federal agencies to require international air travellers to go into quarantine upon arriving in the United States. This order also requires all United States bound passengers from 2 years and older to obtain a negative COVID-19 test result within three days before travelling.

Exceptions to the travel ban on South Africa

Although the travel ban is strictly enforced, there is an exception for those making use of the H-2A visa programme. In terms of this programme, due to a shortage of domestic labour and to avoid food shortage in the United States, employers can temporarily invite and hire foreign workers. These workers must meet the critical skill requirements for the United States’ agriculture sector, subject to local government restrictions. So, any foreign worker providing services along the following lines will be able to travel to the US at this point in time:

  • seafood processors
  • fish cutters
  • salmon roe technicians
  • farm equipment mechanics, and
  • farm labourers.

With new legislation on its way, The US Citizenship Act of 2021, immigrant farmworkers could be eligible for green cards much sooner. After three years, these green card holders could apply for citizenship.
