Fiancé Visa vs. Marriage Visitor Visa – Settling in the UK

One of the main prerequisites for applying for the Marriage Visitor Visa is that you do not intend to stay or settle in the UK after getting married.

If a person does decide otherwise and wants to stay in the UK, they will have to leave the UK, and apply for entry clearance from their home country.

The only exception is for persons who are getting married in the UK to an EU citizen. If the holder of the marriage visitor visa gets married to the EU national, it will be possible to apply for an EU Residence card, without having to leave the UK.

People who are applying for the Fiancé visa, intend to get married to a British citizen or a person with Indefinite Leave to Remain. They also intend to settle in the UK after their marriage. The fiancé visa would thus be the option to choose for persons who intend to settle in the UK with their new partner.

Requirements for the Fiancé Visa

If you are applying for the Fiancé Visa, you will have to fulfil certain requirements. The requirements and restrictions of the Fiancé Visa inter alia include;

  • All previous marriages or civil partnerships must have ended.
  • You plan to marry within six months of your arrival in the UK.
  • You will not be allowed to work during your engagement in the UK.
  • After your marriage, you will be able to apply for a Spouse visa from within the UK.
  • You will be able to apply for Indefinite Leave to Remain after you have lived in the UK continuously for five years. Your time in the UK as the holder of the Fiancé Visa will unfortunately not count towards the five years.
  • You will have to meet the Family Migration minimum income requirement. This is £18,600 a year. This amount increases if you have any children who accompany you as dependents.
