A new UK Home Office concession will bring good news for some young adults in the UK.

Young adults on the ten-year settlement route can qualify for Indefinite Leave to Remain after only five years.

Qualifying earlier for ILR will bring many advantages for those fortunate enough to qualify. Settling in the UK earlier would mean that the applicant will save Home Office application fees and Immigration Health Surcharge fees. Best of all, you should qualify to apply for British citizenship after only one year with the status of ILR.

HOW TO QUALIFY FOR THE EARLY SETTLEMENT CONCESSION FOR YOUNG ADULTS

You have to fulfil the following criteria to qualify for the early Indefinite Leave to Remain concession:

  • Applicants have to be between the ages of 18 and 25 years old;
  • You must either have been born in the UK or entered the UK as a minor;
  • Have held five years limited leave; and
  • Be qualified under and have made an application based on private life grounds (under paragraph 276ADE (1) of the UK Immigration Rules).

If a young adult meets the above requirements, the Home Office will consider granting them early indefinite leave to remain (ILR) on an exceptional basis.

In their decision, the Home Office will also consider various other aspects;

  • Any links the applicant has with the UK;
  • The length of residence the applicant has spent in the UK;
  • Periods of overstaying resulting from non-compliance by the applicant’s parents/guardians. In such cases, the applicant would normally not be held responsible.
