J.Lo jungle dress: Versace vs Fashion Nova settle days before trial

Just days before the trial was set to begin, Versace and Fashion Nova have settled their copyright and trademark infringement lawsuit.

The Central District of California states that both, Italian fashion company Versace and American retail company Fashion Nova have come to an agreement regarding their copyright and trademark infringement lawsuit on 15 July, just days before the trial was scheduled to start.

VERSACE AND FASHION NOVA IN AGREEMENT 

Days before the trial between Versace and Fashion Nova was set to begin, both parties reached an agreement on their copyright and trademark infringement lawsuit. 

According to The Fashion Law, on 15 July, Magistrate Judge Rozella Oliver of the US District Court for the Central District of California stated the parties “agreed to a settlement in principle and will finalize the outstanding matters before the pretrial conference scheduled for 16 July 2021, with the district judge.” 

While the pretrial conference was supposed to be held on 16 July, the trial was set to begin on Monday, 19 July. The settlement closes a year-and-a-half long case that Versace filed against Fashion Nova.  

Versace claimied Fashion Nova was selling “deliberate copies and imitations of [its] most famous and recognisable designs, marks, symbols and other protected elements,” in an attempt to “exploit the popularity and renown of Versace’s signature designs, and to trade on [its] valuable goodwill and business reputation in order to drive profits and sales to line Fashion Nova’s pockets,” according to The Fashion law.

Versace first opened the case against Fashion Nova in November 2019 claiming that the retail brand had copied their black-and-gold baroque motif and the iconic J.Lo jungle print dress.

Fashion Nova clapped back in January stating that the prints are “standard geometric figures and patterns,” and “widely used in the fashion/apparel industry,” according to Dazed Digital.

This was followed by the news that Donatella Versace, sister of Versace’s founder Gianni Versace, may testify at the trial. However, Versace stated that Donatella having to prepare and sit down for a deposition would impose an “undue burden”.

Just a day before the 24th anniversary of Gianni Versace’s death, two men were found dead inside the Versace mansion, where Gianni also lost his life at the age of 50, in 1997.

The Italian fashion designer was shot and killed outside his Miami Beach mansion by serial killer Andrew Cunanan, who killed himself eight days later on a houseboat in North Miami Beach. Ironically the anniversary of Gianni Versace’s death is the same day that Versace and Fashion Nova has come to an agreement to settle their lawsuit.
