In April, BMW filed an application at the Johannesburg High Court, stating that “the plaintiff [BMW Financial Services] shall, without prejudicing his other rights in law, be justified in cancelling the agreement [and], in the instance of such a cancellation, claim return and possession of the vehicle.”

The court papers also reveal that Ndaba allegedly had not handed over the car to the creditor following notice to do so.

However, when called for a comment, Ndaba said: “I have already paid them. You can call BMW.”
