WARRANT OF EXECUTION AGAINST HLAUDI MOTSOENENG

The publication also reveals that the Special Investigation Unit (SIU) told parliament on Tuesday, 28 February that a warrant of execution against assets belonging to former SABC COO Hlaudi Motsoeneng is expected in days to recover the R11.5 million irregular bonus that was paid to him.

“On 19 January 2023, the Supreme Court of Appeal dismissed with costs an application brought by Hlaudi Motsoeneng to appeal the order of the High Court of South Africa: Gauteng Local Division, Johannesburg, declaring the decision of the then SABC Board to pay him R11.5 million as unlawful and invalid. Around August 2016, the then SABC board took a decision to pay Motsoeneng a success fee for clinching the MultiChoice deal.”

“Should Motsoeneng fail to pay within seven days, the High Court ordered the SABC Pension Fund to pay the amount to the SABC or all the pension proceeds where the pension proceeds do not amount to R11,508,549.12,” reports the SIU.

‘R11.5 MILLION PAID BY SABC UNLAWFUL’

The Special Investigation Unit (SIU) reported on 25 January that the High Court ordered Motsoeneng to repay R11.5 million within seven days of the order with interest at the rate of 15,5% per annum calculated from 13 September 2016 to the date of payment.

The court revealed that the decision by the SABC’s former board to pay Motsoeneng the R11.5 million was invalid and unlawful.

TimesLIVE reported that Motsoeneng revealed he did nothing wrong when he was paid the money from the SABC. He reportedly received the exuberant amount after negotiating a deal with MultiChoice for broadcast rights, which includes access to the archives of the SABC.
